Terms And Conditions

Welcome to smconstructiontrade.com. This website offers services within the United Kingdom, including construction, residential renovation, commercial property refurbishment, interior fit-outs, kitchen installation, building extensions, bathroom renovation, flooring installation, painting and decorating, and property maintenance.

By accessing or using this website, submitting a service request, or making a payment, you agree to the applicable Terms of Service. Please read these terms carefully before placing an order or making a payment.

  1. Scope of Services

We provide construction, renovation, and property improvement services tailored to the specific needs of our clients. The precise scope of work, materials, pricing, estimated project duration, and other requirements shall be governed by the quotation, order, or written contract confirmed by both parties.

Service descriptions provided on this website are for illustrative purposes only and do not imply that any project can be executed immediately without prior assessment. Specific projects may require on-site evaluations, planning permission, building regulation approvals, or other necessary authorizations.

  1. One-Off Transactions and Billing Terms

This website operates on a one-off service transaction model. Making a payment does not initiate a monthly or annual subscription, nor does it result in automatic recurring charges.

Each payment corresponds to a specific service request, project deposit, initial installment, or a contractually agreed-upon stage payment. The payment amount, purpose, timing, and associated conditions will be specified in the quotation, order, payment page, or the contract confirmed by both parties.

Depending on the project schedule, clients may be required to make the following types of payments:

Project Deposit: To confirm the project arrangements and initiate agreed-upon preparatory work.

Initial Installment: Payable in accordance with the contract and payment schedule confirmed by both parties.

Stage Payments: For multi-stage construction projects, payments are made based on the progress of the work or specific payment milestones defined in the contract.

Final Balance: Payable according to the settlement method and timeline stipulated in the contract.

All payments due shall be based on the quotation and contract confirmed by the client. Any costs arising from additional work, changes to materials, or adjustments to the project scope must be discussed with and formally approved by the client prior to implementation.

Unless otherwise agreed upon in writing, payments apply exclusively to the specific project for which they are made and do not constitute the purchase of ongoing services or automatically renewing subscriptions.

  1. Payment Methods and Payment Security

This website may process online payments via Stripe or other third-party payment service providers. The specific payment methods available will be those displayed at the time of checkout.

Customers must ensure that the billing information provided is accurate and that they are authorized to use the payment method employed. The success of a payment is determined by the transaction result provided by the payment service provider and the payment confirmation received by us.

Third-party payment service providers may process transactions, verify payment information, and implement fraud prevention measures in accordance with their own terms. Their independent data processing practices are governed by their respective privacy policies.

We will never request that customers provide full bank card security codes (CVV/CVC) or other unnecessary, sensitive payment credentials through unverified channels.

  1. Deposits, Cancellations, and Refunds

Details regarding the amount and purpose of any deposit, its refundability, and the settlement process in the event of a cancellation will be clearly communicated to the customer prior to payment—whether through a quote, payment instructions, or a contract.

Should a customer wish to cancel a project, they must contact us as soon as possible at projects@smconstructiontrade.com. We will handle cancellations and refunds based on the project’s progress, work already completed, reasonable costs incurred, contractual terms, and applicable law.

We will not unreasonably forfeit the entirety of a customer’s prepayment solely due to a project cancellation, nor will we impose unreasonable or disproportionate cancellation fees.

For consumer service contracts entered into online, customers may be entitled to a statutory cancellation period or other consumer rights. The applicable cancellation period, any exceptions, and the amount of any potential refund will be determined by the type of contract and relevant legal requirements. If a customer requests that services commence before the expiration of a statutory cancellation period, we will—where required by law—obtain an explicit request from the customer and inform them of the associated consequences and any reasonable costs that may be incurred.

If services are not provided in accordance with the contract, or if other circumstances arise that legally warrant a refund or remedy, we will address the matter in line with the contract and applicable law. Nothing in these terms shall exclude or limit any rights that consumers are entitled to by law.

  1. Customer Responsibilities

Customers are required to provide truthful, accurate, and complete project information, including the property location, construction requirements, expected budget, and relevant contact details.

Customers must ensure that they have the authority to authorize construction work at the relevant property and, where applicable, have obtained the necessary permissions from the property owner, property management, or other relevant parties. The client shall promptly provide any approvals or documents required by law that necessitate the client’s cooperation.

The client shall, within the agreed-upon timeframe, provide reasonable access to the site, project-related documentation, and any other necessary cooperation. Should the information provided by the client be inaccurate, should the client fail to provide the necessary site access, or should the client request changes to the project requirements, such circumstances may impact construction schedules, costs, or the estimated completion date. Any resulting adjustments shall be discussed and confirmed with the client in accordance with the terms of the contract.

  1. Project Changes and Construction Scheduling

In the event of any changes to the project scope, materials, construction plan, pricing, or timeline, both parties shall confirm such changes—and their impact on costs—in writing.

Project progress may be affected by factors such as weather, material supply, site conditions, third-party arrangements, necessary regulatory approvals, or other reasonable factors beyond our control. Should such situations arise, we will notify the client as soon as reasonably practicable and discuss appropriate adjustments.

We will not arbitrarily increase the contract price or make substantive changes to the agreed-upon scope of services without proper confirmation.

  1. Intellectual Property

Unless otherwise stated, all text, page designs, graphics, logos, photographs, service descriptions, original documents, and other content on this website are the property of the website operator or the respective rights holders and are protected by applicable intellectual property laws.

Without the prior written consent of the relevant rights holder, you may not copy, reproduce, sell, distribute, modify, or use the content of this website for commercial purposes, except as expressly permitted by law.

The ownership of intellectual property rights regarding project designs, drawings, plans, photographs, and other deliverables—as well as the scope of the client’s permitted use—shall be governed by the project contract or a separate written authorization. The client retains all rights to any photographs, drawings, or other materials they submit; the client warrants that they possess the authority to grant us the right to use such materials for the purposes of providing quotations, executing construction, and managing the project.

Unless otherwise agreed upon in writing, the payment of service fees does not automatically grant the client ownership of any intellectual property rights held by us or by third parties.

  1. Acceptable Use and Prohibited Conduct

When using this website, you must comply with applicable laws and these Terms. You shall not:

Submit false identity information, payment details, or misleading project information;

Use unauthorized payment methods or engage in fraudulent activities;

Access, interfere with, or disrupt the website, servers, or related systems without authorization;

Upload malicious software or attempt to circumvent website security measures;

Reproduce, sell, or commercially exploit protected content from this website without authorization;

Use this website to engage in illegal activities, infringe upon the rights of others, or harass others.

In the event of a violation of these Terms, we may—depending on the circumstances—take actions such as suspending requests, canceling unconfirmed service arrangements, restricting access to the website, or seeking legal remedies and compensation. When taking such actions, we will consider our contractual obligations, the specific circumstances, and applicable laws, ensuring that we do not deprive customers of their rights under the law.

  1. Limitation of Liability

We will provide the agreed-upon services with a reasonable level of professional skill, in accordance with our contract and applicable laws.

For losses arising from inaccurate information provided by the customer, unauthorized construction requests, the actions of third parties, or events reasonably beyond our control, we will determine liability based on the specific circumstances and the terms of our contract, to the extent permitted by applicable law.

To the maximum extent permitted by law, we shall not be liable for indirect or consequential losses that were not reasonably foreseeable, except where otherwise provided by applicable law.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any statutory rights afforded to consumers under the law.

Any limitation of liability shall be interpreted in accordance with applicable law and the specific terms of the contract, and shall not be construed as an exemption from liabilities that we are legally required to bear.

  1. Dispute Resolution

If you have any concerns or objections regarding services, quotes, payments, construction arrangements, or refunds, please contact us first via the following email address:

projects@smconstructiontrade.com

Please include the relevant project, order or transaction number, the nature of the dispute, and your preferred resolution. Both parties agree to first attempt to resolve the issue through reasonable communication. If a dispute cannot be resolved through negotiation, the parties may—in accordance with applicable law—seek mediation, pursue other appropriate dispute resolution methods, or commence legal proceedings in a court of competent jurisdiction.

Nothing in these terms requires consumers to waive their legal right to initiate litigation, nor does it restrict them from seeking assistance from relevant consumer protection agencies or regulatory bodies.

  1. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of England and Wales, without prejudice to any mandatory consumer protection rights provided by law.

Disputes arising in connection with the services provided on this website shall be subject to the jurisdiction of the competent courts. These terms do not exclude any statutory rights that consumers may have regarding alternative venues or jurisdictions.

If the actual operating entity is based in Scotland or Northern Ireland, or if the specific nature of a project requires the application of different laws, these terms shall be adjusted accordingly based on the actual place of operation, the nature of the contract, and the applicable legal requirements.

  1. Third-Party Services and External Links

This website may provide access to third-party payment services or links to external websites. Such third-party services are provided by the respective service providers under their own terms; we have no control over the content, availability, or data processing practices of these third-party sites.

Before using any third-party service, you should review the relevant terms and privacy policies. The use of third-party services does not absolve either party of their obligations under this contract or applicable law.

  1. Updates to Terms and Severability

We may update these terms to reflect legal requirements, changes in the scope of our services, or shifts in our operational practices. Updated versions will be posted on this website, accompanied by the date of the update.

Updates will not automatically alter the terms of a contract already agreed upon by the parties, unless such changes are mutually consented to or are otherwise permitted under the contract and applicable law.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by applicable law.
